How do I know if my business qualifies?

All businesses with employees in Colorado are required to register for the program unless they meet one of the below exceptions:

  • A qualified, employer-sponsored retirement plan is one that is qualified under Internal Revenue Code sections 401(a) (including a 401(k) plan), 403(a), 403(b), Simplified Employee Pension plan under section 408(k), SIMPLE IRA plan under section 408(p), or governmental deferred compensation plan under section 457. (b). It excludes payroll deduction IRAs. You never employ more than 5 employees at any one time, not counting employees under the age of 18 or employed for fewer than 180 days.
  • Your business is less than 2 years old.

As a small business owner, you can still opt in and offer the program even if you are not mandated to do so.

If you qualify and do not enroll, there are penalties or fines for noncompliance. There will be $100 per employee per year with a cap of $5,000 per year.

Colorado SecureSavings is a new retirement savings programme administered by the Office of the State Treasurer's Colorado SecureSavings Board. More than 40% of Colorado's private-sector employment, or roughly 940,000 people, do not have access to a workplace retirement savings plan. Colorado SecureSavings was founded to address this pressing need.

Businesses may help their workers save for retirement in a handy Roth Individual Retirement Account (IRA) that is transferable even if they move or leave their employment with Colorado SecureSavings. This new initiative makes it simple for Colorado workers to save for the future.
